OVAM, SPW and Brussels Environment attach great importance to the protection of personal data and privacy. This statement explains how we collect, process and use your personal data in the context of the TOTEM tool.

This privacy statement sets out the general data processing and protection policy of:

  • For the Flemish Region: The internal autonomous agency with legal personality (Openbare Vlaamse Afvalstoffenmaatschappij (OVAM)) whose head office is located at Stationsstraat 110, 2800 Mechelen and company number 0842.399.963;
  • For the Walloon Region:  The General Secretariat of the Public Service of Wallonia (SPW), whose head office is located at Place de la Wallonie (JB), 1, 5100 Namur and whose company number is 0316.381.138
  • For the Brussels region: Brussels Environment, whose head office is located at Havenlaan 86C bus 3000 (Tour & Taxis site), 1000 Brussels and whose company number is 0236.916.956, represented by Barbara DEWULF, Deputy Director General and Frédéric FONTAINE, Director General.

Who processes your personal data?

OVAM, SPW and Brussels Environment process your personal data. In this privacy statement, we use the personal pronoun "we" to refer to OVAM, SPW and Brussels Environment.

We are responsible for processing your personal data as described and explained in this statement. We process personal data and only allow it to be processed if this is necessary for the performance of the tasks entrusted to us. We always process data in accordance with the provisions of the General Data Protection Regulation (GDPR), as well as the provisions of the Federal Personal Data Protection Act.

When do we collect and process your personal data?

We collect and process your personal data when you use one of our services or contact us in connection with the services we provide in the context of the TOTEM tool. We may also process your personal data if you ask us a general question, for example via the TOTEM helpdesk.

What data do we process about you?

We process your personal data. This is data that identifies or links you as a natural person.

The categories of personal data that we process in the context of the services we provide through the TOTEM tool are as follows:

  • Mandatory data: profession, e-mail address, possession of a licence for an LCA database;
  • Optional data: first name, surname, language, address, telephone and organisation.

How do we collect and process your personal data?

In the context of the TOTEM tool, we collect personal data directly from you. The personal data you submit to us are partly mandatory and partly optional. The mandatory personal data you provide in the TOTEM tool is necessary to create a user profile in the tool so that you can use our services. Optional personal data is provided voluntarily to enable us to tailor our services to your needs.

What are the purposes of processing your personal data?

The authorities, namely OVAM, Brussels Environment and SPW (us), encourage the use of sustainable materials in the public interest. To support this objective, they offer professionals and building owners the TOTEM tool, a tool to calculate the environmental impact of a (future) construction project.

End users who voluntarily register in the TOTEM database by means of their e-mail address enter into a user agreement, which forms the legal basis for the processing of their data.

In addition, the data is processed for statistical purposes, so that we can evaluate the use of the TOTEM tool. This further processing, based on anonymous data, is not incompatible with the original purpose of making the TOTEM tool available.

How long do we keep your personal data?

As a general rule, we may only retain your personal data for as long as is necessary to provide our services. We will therefore keep your data for as long as you use our services.

Your user account is active as long as you use the service provided. All employees who need your data to be able to perform their tasks then have access to your data.

If you have not logged in to your TOTEM user account for 2 years, you are considered an inactive user.

After 2 years of inactivity, an email will be automatically sent to you to inform you that your account will be automatically closed if you do not log in to your TOTEM account. Without action on your part, your account will be closed 30 days after the email is sent.

You can also close your account on your own initiative. Either via your TOTEM user profile or by asking the Helpdesk to have your account closed.

After closing your account (automatically or at the user's request), your data will be stored for a period of 6 months. After this period, your account will be permanently closed and all your data will be deleted.

Do we share your personal data with others?

Your data is mainly processed internally by our staff.

For some specific services, we may use subcontractors to process your data. For example, the tool is currently operated by our partner HEMMIS.

We transfer your data to this subcontractor so that they can provide the service in question. We monitor this at all times.

Will your personal data be transferred outside the European Union?

We do not transfer your data to countries outside the European Union or to international organisations. These are countries or organisations outside the territory of the European Economic Area (European Union + Iceland, Norway and Liechtenstein).

What are your rights?

You can object to the processing of your data at any time by closing your account. You can always view the data we process about you by logging into your user account, you can copy it (via extract) and, if necessary, correct it.

If you do not agree with the way we process your data, you can contact the Data Protection Officer (DPO) of OVAM, SPW or Brussels Environment by sending an e-mail to:

You may also lodge a complaint with the competent Data Protection Authority if you consider that this processing violates the applicable regulations.
